GENERAL INFORMATION, TERMS & CONDITIONS
1. ProActive Field Services [PFS] provides residential and commercial real estate sign installation service in the greater southeast Florida
region spanning the counties of Indian River, Port St. Lucie, Martin, Palm Beach, Broward and Miami-Dade.
2. For convenience, PFS provides access to an ordering system to its customers for easy order entry and payment for sign
installations/removals or purchasing new signs. Orders requested outside of this system will require an additional order entry fee.
Orders are completed in 1-3 business days weather permitting (with most within 2 days). New sign manufacturing orders will be
immediately directed to our approved sign supplier partner for fabrication, and they will be solely responsible for all aspects of the
transaction with the customer including specifications, communication, order fulfillment. billing and payment receipt. The supplier will
inform PFS when signs are ready for pickup and PFS will create a pickup order in our system on the customer’s behalf and place the
items into our inventory for the customer’s current or future installations.
3. As part of its Installation service, PFS will provide signpost(s) and any accessories offered and selected by the customer including
brochure boxes, lock boxes and generic riders. All are and will remain the property of PFS. A missing fee will be required for any of
these furnished items that are not able to be retrieved (in a similar condition) at the time of removal.
4. Prior to ordering, the following is the responsibility of the person/customer placing the order:
a. Obtaining approval of the owner of the property for the sign installation.
b. Obtaining all necessary approvals and permits (if required) from and payment of any necessary fees to all private and public
entities who have jurisdiction including but not limited to county governments, city governments, building departments,
homeowner’s associations, condominium associations, etc. If the customer fails to obtain the necessary approvals or to pay
any necessary fees, the customer will indemnify and hold harmless PFS for any and all costs incurred by PFS including
damages paid, court costs, and attorney’s fees through the administrative, trial, and appellate levels in defending against any
such claim.
c. For in-ground installations, ensuring the property involved is free from any electrical cabling, TV/Internet cabling, piping,
irrigation lines, or any other underground item. If such underground items are not properly marked all financial liability for any
damage is the responsibility of the person/customer who requested the installation.
d. For installations affixed onto a building or other above-ground structures, PFS will take care as best as possible to minimize
damage but will not be responsible for any damage except for damage if caused by gross negligence.
5. When ordering, the following is the responsibility of the person/customer placing the order:
a. Creating an account in our system and logging in by going to our website at www.proactivefieldservices.com and clicking on
the Place Order Button. Note: If for some reason you do not see our logo when placing an order, you’ll need to refresh your
browser by clicking on the SETTINGS TAB in the upper right corner of the screen then click on the CLEAR COOKIES BUTTON
on the left of the screen then place your order.
b. Once logged in, Click on the Installation Order then the icon to the left of the screen. When the form opens, skip the order
needed by date if immediate. Then click on an actual add to avoid the renewal fee ress from the dropdown menu that appears
in the address field when starting to type to confirm it is an actual GPS recognized address. Note: For vacant lots can enter
the closest address you can find to guide the installer to the vicinity then in the notes field provide instructions from there to
the lot.
c. In the bottom three columns, select the desired post-type, whether PFS is hanging the sign panel or the customer is, and any
desired accessories. Note: all this information is necessary so that it will be added properly to the installer’s picklist.
d. In the comments/notes field, if you have special instructions or need to provide property access information be very specific
and place them here for the Installer [for vacant lots include instructions/directions from the address that was entered above to
the lot]. If there are no special instructions, the system requires something in this field for instance “Thank you”.
e. When all the fields are complete and payment is applied, hit the submit button and you will receive an immediate Pending
Order email confirming your order has been placed. You will also receive follow-up email alerts when your order is scheduled
and another when it has been completed with a photo attached.
f. When the property listing is no longer active, for removal orders, a list of your active installations will come up when you click
on the Removal Order button, so you just click on the one you want to have removed and submit. The system will carry all
the necessary information over from the original installation order.
6. In the event of any Act of God such as a hurricane or other natural disaster, terrorism, or other event outside PFS’ control, PFS shall
not be responsible for any damage caused by the customer’s order, whether such damage is to property or person. In the event of a
hurricane, the posts can remain in the ground, but it is the responsibility of the customer to remove the sign panels and riders (if any).
When the hurricane has passed and all clear, the customer can place a repair order to reinstall the sign panel(s) and any riders if
desired or place a removal order.
7. Installation renewals are issued every six months for extended property listings. As a courtesy, an email is sent out to the customer
several days in advance to alert them of the upcoming fee and allow them to place a removal order to avoid the renewal fee if they
happened to forget.
8. In the event of a dispute between PFS and the customer arising out of these terms and conditions or services provided by PFS, by
placing their order, the customer agrees to these terms and conditions and that any such dispute shall be brought in the state courts of
the 15th Judicial Circuit in and for Palm Beach County, Florida. Each party accepts the jurisdiction of such Court and waives any
objection based on personal jurisdiction, improper venue, or forum non conveniens. In the event of any suit, action, or other proceeding
brought to enforce any aspect of this Agreement, the prevailing party shall be entitled to recover its costs, including attorney’s fees, at
all levels of the proceedings, including but not limited to trial court and appellate court, and including any pre-suit costs and attorney’s
fees.
